MSU TEAM COMPETES IN THE WILLIAMS INSTITUTE MOOT COURT COMPETITION!

The Williams Institute hosts the only national competition dedicated exclusively to the areas of sexual orientation and gender identity law. The Competition provides an opportunity for students to research and write an appellate brief on a current legal topic, practice arguments before sitting state and federal judges, and compete in a high caliber national competition among other top ranked law schools. The Competition is designed to promote the finest oral and written advocacy on a significant problem in sexual orientation and gender identity law. National organizations, think tanks, academic institutions, and law firms support and participate in this competition as sponsors and judges. The Competition provides a unique opportunity for students interested in sexual orientation and gender identity law to gain national exposure and recognition with colleagues and future employers.

The MSU Law Triangle Bar Association in conjunction with the Michigan Project for Informed Public Policy (MPIPP) is hosting a KUP Training at MSU LAW. The training is non-partisan, research based, and supported by the Michigan Psychological Association and the Arcus Foundation.

As individuals become sensitized to the mental health consequences of discrimination and stigma, research tells us that they are more likely to actively support public policy regarding equality for LGBT people.

Michigan Governor Signs HB 4770 – Banning Partner Benefits for Public Employees

Michigan Governor Rick Snyder signed HB 4770 into law on December 22, 2011.  This law will bar public employers from providing domestic partner protections to their employees. It is unclear at this time if this will effect the ability of public universities to offer domestic partner benefits.

House analysts indicate that the legislation would not exclude public universities.  Senate analysts indicate that the legislation would exclude public universities.  Snyder indicated that he does not believe the state can stop public universities from offering benefits to domestic partners because of the autonomy granted to them through the state constitution.

TRANSGENDER DAY OF REMEMBERANCE 2011

The annual Transgender Day of Remembrance (TDOR) memorializes individuals who have been killed throughout the world in the previous year because of anti-transgender hatred.

Triangle Bar Association honored  our transgender community by promoting awareness and visibility in the law school lobby and providing information about the recent death of Shelley Hillard in Detroit Michigan.

November 20th is the 2011 Transgender Day of Remembrance. Because of Thanksgiving break, Triangle Bar Association will be observing TDOR on November 17th, 2011.

Is HATE a Michigan Value? A Panel Discussion on the Current Ant-Gay Legislation in the Michigan House and Senate

A Panel Discussion on the Current Ant-Gay Legislation in the Michigan House and Senate, sponsored by the MSU COL Diversity Services Office, MSU COL Triangle Bar Association, MSU GLFSA (Gay, Lesbian, Bisexual, Transgender, Faculty, Staff, and Graduate Student Association), and The Alliance for Queer an Ally Students was held on November 15, 2011.

Four bills (HB 4770-4771, HB 5039, and HB 5040) that could impact the citizens of the state of Michigan and the ability for Michigan businesses and universities to attract and retain talent and promote economic growth will be highlighted. These four bills send a strong message that it is acceptable to discriminate against LGBTQ individuals. This informative and educational panel will explore the legal and economic arguments against the perils of the proposed legislation.

Melanie Jacobs, Professor, MSU College of Law moderated the panel.

Bart Feinbaum, Principle Counsel of Blue Cross Blue Shield of Michigan discussed the business and economic impact that this legislation will have on the state and how it affects the insurance industry.

Attorney Jay Kaplan from the ACLU of Michigan outlined the current legislation and provided legal analysis.

Christy Mallory co-author of the recent report on Economic Motives for Adopting LGBT-Related Workplace Policies released by the Williams Institute addressed the economic impact of this legislation and the national trends regarding anti-gay legislation.

Nancy Costello, Co-Director of the Great Lakes First Amendment Law Clinic and Associate Clinical Professor of Law, Michigan State University College of Law presented information about how individuals and families will be affected by this legislation and the stressors placed on the LGBTQ community.

LEGISLATIVE UPDATE 2011

HB 4770 &4771, HB 5039 and HB 5040 are making their way through the Michigan State Legislature.

  • HB 4770 and 4771 are tie-barred, and both would restrict public employers from providing medical and other benefits to anyone living with a public employee unless they are married to, or a dependent of, the public employee, or the individual is a valid inheritor to the employee’s intestate will under Michigan’s intestate successor laws.
  • HB 5039 prohibits any state agency or unit of local government from creating a protected class classification that is not expressly included in the statute.  The Elliott-Larsen Act does not include sexual orientation or gender identity as protected characteristics.
  • HB 5040 proposes that counseling, social work, or psychology students can refuses to counsel or serve a client as to goals that conflict with a sincerely held religious belief or moral conviction of the student counselor. This bill would violates American Counseling Association’s Code of Ethics, which forbids counselors from discriminating in their practice, or imposing their own values, attitudes and beliefs on their clients and would violate campus discrimination policies.
